Our agreement

I’m excited to work with you to help you achieve your goals and reach your full potential.

This agreement outlines the terms and conditions of our relationship, and I ask that you take a few minutes to read it carefully, to ensure you get the most out of our work together.

This Client Agreement comes into effect from today, 16 January 2026 (the effective date), between me, Nicola (Nikki) and yourself (the client), or from the date when you first purchase services from me. I recommend that you print a copy of this agreement for your records.

Purpose and scope

The purpose of this agreement is to establish a working relationship between us, designed to facilitate your personal, professional, and/or business growth and development.

Our relationship will be a collaborative and supportive partnership, and I’ll work with you to help you identify and achieve your goals, and maximise your potential.

My services

As your guide, I’ll provide you with:

  • Guidance, using the communication channels offered in the specific product or service you purchased
  • Insights, resources and support to help you achieve your goals, as appropriate
  • Exploration of different areas of your life, as directed by you, including work, finances, health, and relationships
  • Help in identifying and overcoming obstacles and challenges
  • Support in developing strategies and plans to achieve your goals
  • If and as required, value clarification, brainstorming, identifying plans of action, examining modes of operating in life, asking clarifying questions, and making empowering requests or suggestions for action

Your responsibilities

As the client, you agree to:

  • Be actively involved and committed to the guidance process
  • Participate with an open mind and a readiness to move forward
  • Allow me to challenge your thinking and behaviours to support your development
  • Set goals and actively work towards achieving them
  • Take responsibility for implementing the techniques and strategies discussed during our conversations
  • Complete all tasks as agreed, to the best of your abilities, before seeking further input
  • Be honest and transparent about your progress and challenges
  • Provide feedback and insights to me, including communicating with me if you believe the service is not working as you would like

My responsibilities

As your guide, I agree to:

  • Maintain confidentiality and adhere to ethical guidelines
  • Provide a safe and supportive environment for you
  • Engage in direct and personal conversations with you
  • Be open and honest about our working relationship
  • Provide opportunities for growth and learning
  • Seek feedback and review outcomes achieved against the goals set
  • Be available to answer your questions and provide support via the specified communication channels

Communication

I will communicate with you via the channels offered as part of the service you purchased. I am not available to provide services of any kind via other channels.

I will assume that any technologies or platforms you use to communicate with me, are acceptable for me to continue using with you, unless you say otherwise.

Privacy

You can, at any point in the guidance process, state that you would prefer to not discuss a specific issue, and I will respect this boundary and will not continue the conversation along those lines.

Confidentiality

I understand that confidentiality is essential in our relationship. I agree to maintain the confidentiality of all information shared by you, except in rare circumstances where decreed by law or as agreed with you in writing.

If I take any notes as part of our working relationship, I will ensure that they are either securely stored or safely destroyed.

You understand that there are exceptional circumstance where I may not be able to provide confidentiality, such as intent to seriously harm someone, child abuse etc.

You understand that certain matters may be anonymously and hypothetically shared with other service professionals for training or consultation purposes.

Prior history

You agree to disclose details of any past or present psychological or psychiatric treatment, unless there are clear and important reasons for not doing so. Failure to disclose any such treatments may adversely impact the results you receive from these services, for which I will not be held responsible.

If any mental health difficulties arise during the course of our work together, you will notify me immediately so that we can discuss appropriate steps and any additional referrals that may be needed.

Fees and payment

We agree that the fees for our service arrangement are as outlined in the purchased product or service.

Additional services can be organised as needed, and I’ll provide you with a clear understanding of the costs involved before proceeding.

You agree to pay all fees in full, in advance, unless otherwise offered as part of the product or service.

Cancellation

If you need to cancel a real-time service, session or appointment, if and where offered, please provide me with at least 48 hours’ notice of cancellation.

If you cancel with less than 48 hours’ notice, I reserve the right to charge you in full for the scheduled service.

Termination

Our working relationship will continue for the duration of the agreed period, as outlined in the purchased product or service.

Either of us may terminate this agreement at any time upon written notice to the other, with a minimum of 48 hours’ notice.

I reserve the right to cancel your services without consultation or discussion with you, if I decide that my services are not a good fit for your situation.

Refunds

I will only offer refunds if you haven’t yet made use of any of the purchased service in any way, and I haven’t yet spent any time at all providing the service to you, in any form.

In the event that I am willing to provide a refund (full or partial), if there are any fees I’ve incurred in processing your purchase (such as credit card transaction fees or administrative costs), I’ll deduct these from your payment and refund you the remainder.

Guidance outcomes

You understand that guidance is a comprehensive process that may involve all areas of your life, including work, finances, health, and relationships.

You acknowledge that all decisions in these areas are exclusively yours and you acknowledge that your decisions and actions regarding them are your sole responsibility.

You understand and agree that you are fully responsible for your physical, mental and emotional well-being during any communications, including your choices and decisions.

You are aware that you can choose to discontinue any services at any time.

You understand that guidance is not intended as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals.

You agree to seek independent professional guidance for legal, medical, financial, business, spiritual or other matters, as you see fit.

Guidance is NOT therapy

You also understand that guidance is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment.

If you are currently in therapy or otherwise under the care of a mental health professional, you confirm that you have consulted with that professional regarding the advisability of working with a coach or guide, and that professional is aware of your decision to proceed with our working relationship.

Limited liability

I make no guarantees, representations, or warranties of any kind or nature, expressed or implied, with respect to the services negotiated, agreed upon, and rendered.

Under no circumstances will I be liable to you for any indirect, consequential, or special damages.

Entire agreement

This agreement is to be taken in combination with the Terms of Service, Privacy Policy and Terms of Purchase as found on the Wisdom Stirring website.

All of these legal documents form the entire agreement between us and reflect our complete understanding of our arrangement.

Dispute resolution and legal fees

In the event of a dispute arising out of this agreement that cannot be resolved by mutual agreement, we agree to engage in mediation.

If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.

Severability

If any part of this agreement is found to be invalid or unenforceable for any reason, the remaining parts will continue to be valid and enforceable.

Waiver

The failure of either of us to enforce any part of this agreement will not be interpreted as a waiver or limitation of our right to subsequently enforce and compel strict compliance with every part of this agreement.

Applicable law

We agree that this agreement will be governed and interpreted in accordance with the laws of the state of Victoria, Australia, and will abide by any judgement arising from these courts.

Our acceptance of these terms

By using the purchased services, you acknowledge that you have read, understand, and agree to the terms and conditions outlined in this agreement.
